Terms of Service

Last updated: 11 October 2026

These Terms of Service ("Terms") govern your access to and use of the JW Builder website builder and related services (the "Service"), operated by JW Digital Services Ltd("we", "us", "our"). By creating an account or using the Service you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 18 years old and able to form a binding contract to use the Service. By using it you confirm that you meet these requirements.

The Service is built for businesses, and we ask you to tell us if that is not you. By subscribing to a paid plan you confirm you are doing so for the purposes of a business, trade, craft or profession — including as a sole trader — rather than as a consumer.

That confirmation does not take away rights the law gives you. Whether someone is a consumer is a question of fact, not of wording, and if you are one you keep every protection that follows from it. So that the question never has to be argued, we give the same fourteen-day cancellation right in section 7 to everyone, business customer or not.

2. Your account

You must provide accurate information when registering and keep it up to date. You are responsible for keeping your password secure and for all activity under your account. Notify us promptly of any unauthorised use.

3. Acceptable use

You agree not to:

4. Your content

You retain ownership of the content and sites you create. You grant us a limited licence to host, store, and display that content solely to operate and provide the Service. You are solely responsible for your content and for ensuring you have the rights to use it.

5. Your customers' data

When a visitor sends an enquiry through a site you build with the Service, that enquiry — their name, contact details, and message — is your data, not ours: for it, you are the data controller and we act as your processor under UK data protection law. Our Data Processing Addendum forms part of these Terms and sets out how we process it, including automatic deletion 12 months after receipt. You are responsible for handling enquiries lawfully — including telling your visitors how you use their details and honouring their data protection rights.

6. Plans and billing

The Service offers a free plan and an optional paid "Pro" subscription. Pro is charged per website, not per account, so each site you upgrade is its own subscription.

On the free plan you can build up to ten websites and have up to three of them published at any one time. Sites you upgrade to Pro do not count towards either limit. A custom domain (a web address of your own) is part of Pro, so a site on the free plan stays at its free address.

Prices are shown in pounds sterling and are the total you pay — there is no VAT to add. Paid subscriptions are billed in advance and renew automatically for further periods of the same length, through our payment processor, Stripe. By subscribing you authorise us to charge the applicable fees to your payment method on each renewal until you cancel. We will give you reasonable notice before any change to the fees.

You can cancel at any time from your account settings or the billing portal. Cancellation takes effect at the end of the current billing period and you keep Pro until then — we do not stop a plan you have already paid for.

7. Cancelling, and getting your money back

If you change your mind within fourteen days of starting a paid subscription, tell us and we will refund it in full. You do not have to give a reason. This applies to every customer, whether or not the law would treat you as a consumer, and it applies to the first payment of a new subscription — monthly or annual.

To use it, email support@jw-digital.co.uk from the address on your account, or cancel from the billing portal and tell us you want the refund. You can say it in any words you like; there is no form to fill in. We will refund to the card you paid with, normally within five working days.

After those fourteen days, cancelling stops the next payment rather than refunding the current period, and fees already paid are not refunded except where the law requires it.

If you are a consumer — that is, if you are buying wholly or mainly outside your trade or profession — you also have a statutory right under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 to cancel a distance contract within fourteen days of entering into it. Because Pro starts as soon as you subscribe, you are asking us to begin the service within that period; if you then cancel, the law lets us charge for what you actually used. We do not: the refund above is the full amount, which is more than the statute requires. Nothing in these Terms affects that statutory right or any other mandatory consumer protection.

What cancelling does not do

Cancelling never takes your website offline. A published site stays published at the free address it came with, and nothing you have built is deleted. What you lose is what Pro adds: the small "built with" line returns to your pages, and the site goes back to counting towards the free plan’s limits.

If that puts you over those limits — say you had ten free sites and one Pro site — nothing is removed and nothing goes offline. Every site you have keeps working exactly as it did. The only thing that stops is adding more: you cannot create another site, or publish another one, until you are back within the limits. Deleting a site, unpublishing one, or subscribing again all get you there.

A custom domain is treated more gently still. It enters a fourteen-day grace period rather than stopping at once; we email you when it starts and again three days before it ends, and your site stays online at its free address throughout.

8. Availability and changes

We may modify, suspend, or discontinue any part of the Service at any time. We aim for high availability but do not guarantee the Service will be uninterrupted or error-free. Features may change as the Service develops.

9. Reported content and takedown

Sites published through the Service are the responsibility of the account that publishes them. If we receive a report that published content is illegal or breaches section 3, we will review it and may unpublish the content or suspend the account while we do — see Report a site for how to notify us and what happens next. Where the law requires us to act on a notice, we will.

10. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you breach these Terms or use the Service in a way that risks harm to us or others. On termination your right to use the Service ends and we may delete your data in accordance with our Privacy Policy.

11. Disclaimers and liability

The Service is provided "as is" without warranties of any kind, to the fullest extent permitted by law. Nothing in these Terms limits liability that cannot be limited by law (including for death or personal injury caused by negligence, or for fraud). Subject to that, we are not liable for indirect or consequential loss, loss of profits, or loss of data, and our total liability arising from the Service is limited to the greater of the amount you paid us in the 12 months before the claim or £100.

12. Governing law

These Terms are governed by the laws of England and Wales, and the courts of England and Wales have exclusive jurisdiction, subject to any mandatory consumer protections in your country of residence.
